Terms of Use

These terms of use (the “Terms”) set out the conditions for using the app Mihariko (the “App”) provided by Aptume (“we”). By using the App, you agree to these Terms.

Article 1 (Your responsibility)

You are responsible for following the terms of use and other rules of the websites you watch with the App.

Article 2 (Prohibited use)

When using the App, you must not:

  1. Breach the terms of use of the websites you watch
  2. Log in to someone else’s account or otherwise access a website without authorization
  3. Put an excessive load on the websites you watch
  4. Breach any law or public order and morals

Article 3 (Disclaimer)

We do not guarantee that the App checks pages at the intervals you set, that notifications are always delivered, or that every change to a web page is detected.

If you suffer damage through our ordinary negligence, our liability is limited to the ordinary damage you actually suffered, up to an amount equal to the selling price of the App’s paid features (Pro).

Nothing in these Terms limits any rights you have under consumer protection laws that apply to you.

Article 4 (Paid features)

The App’s paid features (Pro) are a one-time purchase made through Google Play in-app billing. Purchases, payments and refunds follow Google Play’s terms and procedures. The paid features are described on the Pro screen in the App. If you are a minor, please get your parent’s or guardian’s permission before purchasing.

Article 5 (Changes to or end of the App)

We may change the App or stop providing it. Before we stop providing the paid features, we will announce it on this page and in the App a reasonable time in advance.

Article 6 (Changes to these Terms)

We may change these Terms. When we do, we will announce the changed Terms and the date they take effect on this page and in the App a reasonable time before that date.

Article 7 (Severability)

If any provision of these Terms, or any part of one, is held invalid or unenforceable under any law, the remaining provisions, and the rest of that provision, remain in full force and effect.

Article 8 (Governing law and jurisdiction)

These Terms are governed by the laws of Japan. The district court with jurisdiction over our place of business has exclusive jurisdiction in the first instance over any dispute about these Terms or the App, except where the consumer protection laws that apply to you give you the right to bring proceedings elsewhere.

Article 9 (Language)

These Terms are a translation of the Japanese original. If the two differ, the Japanese version prevails.
